This regulation establishes the Department of Energy (DOE) policies and procedures for nonprocurement debarment and suspension, adopting and supplementing guidance from the Office of Management and Budget (OMB). It specifies who must comply with these policies, including participants in covered transactions, respondents in DOE actions, and DOE officials involved in nonprocurement transactions, and outlines the methods for communicating and enforcing these requirements down through lower tiers of transactions. Additionally, it defines key roles within DOE and the National Nuclear Security Administration (NNSA), such as debarring and suspending officials, and limits the extension of these requirements to first-tier procurement contracts only.
